How To Get a Medical Marijuana Card in New York

The State of New York has the most effective medicinal marijuana program in the United States. After the implementation of the alterations in the medicinal marijuana program by the OCM during 2022-2023, there are no qualifying conditions, no card, and the patients are enrolled right after getting the certification without registering again in the state.

Legalization of cannabis for medical use took place in 2014, while the decriminalization of recreational marijuana occurred in 2021 with MRTA. However, despite the legalization of recreational use among adults, certification of medicinal use still holds some advantages, such as lower costs, higher amounts, earlier access starting at age 18, homegrown production, and added safety.

The Medical Marijuana Program is managed by the Office of Cannabis Management in the state of New York. The program involves management of the provider registration, patient certification, and Registered Organization (RO) or dispensary.

For one to be certified for medical marijuana in the state of New York, the following are required:

• Must be a resident of New York State (must be either a citizen or a temporary resident of New York State)
• Above 18 years of age (in case of children below 18 years, then must have a designated caregiver)
• A certificate from a physician of New York State licensed with the OCM

No felony history, no fees.

The qualifying medical conditions do not exist on the New York state list anymore since 2022. Practically, any OCM-approved provider can add a qualifying patient for any disease that their practitioner thinks should be treated with marijuana. The examples of the qualifying diseases in New York are chronic pain, post-traumatic stress disorder, cancer, epilepsy, multiple sclerosis, anxiety disorders, glaucoma, AIDS and HIV, amyotrophic lateral sclerosis, and opiate use disorder.

Who Can Certify Patients?

The requirement for provider certification for New York Medical Marijuana Program requires that the provider should be registered with the Office of Cannabis Management, should have the authority to prescribe drugs in the state of New York, and has undergone at least two hours of training on the OCM approved cannabis training program.

The process in New York is the easiest among all states in this guide – only two steps.

Step 1: Get Certified by an OCM-Registered Provider

Find an authorized provider in New York and enroll with them in the OCM. The telemedicine sessions are available and accepted. At your appointment, your doctor will:

• Review your health record and symptoms
• Determine whether cannabis could benefit you
• Sign and issue you a digital prescription using your personal ID

Your enrollment happens automatically upon issuance of your prescription. No separate application to the government, registration on any portal, or waiting required.

Step 2: Use Your Certification at Any Licensed Dispensary

Your registry ID will be found in your certification. Bring your certification and your government-issued ID to any authorized RO pharmacy within the State of New York. That is all that is required – no card and no form required at all.

Recommendation: You can go to Health Applications – Medical Marijuana Data Management System using your my.ny.gov account and obtain an electronic registry card for yourself as a provisional registration. 

No State Fee – No Physical Card Required

Registration charges are nonexistent in New York. The sole charge that you may incur is that of the provider’s, varying from $45 to $150 based on your choice.

Since March 20, 2023, no physical card is issued to you by default in New York. All that you need at any RO is your certification and a valid photo ID. You can get your free physical card from the OCM.

Bring your certificate along with a valid photo ID to any RO dispensing medical marijuana in New York State that is licensed by the state government.

Possession Limits

The quantity allocated will vary from one certifying agency to another, though by default, a prescription will be written for 60 days’ worth of marijuana. However, a doctor may impose restrictions on dosage or write a shorter certificate period.

Home Cultivation

Those patients and their caretakers who are over 21 years old have been able to buy seeds or immature plants at authorized RO facilities and cultivate up to six plants (only three should be mature) per household in a concealed area since October 5, 2022.

Benefits Over Recreational Access

• Lower costs – medical marijuana is cheaper compared to recreational marijuana
• Increased possession allowance – 60-day supply authorized by the dispensing practitioner versus recreational limits
• Growing marijuana at home – permitted for eligible patients and their caregivers who are above 21 years old
• Legalization for those 18 years old – recreational marijuana requires you to be at least 21 years old

A certified individual can choose up to five caregivers. The caregivers should:

• Be aged 18 years or above and be a resident of New York state
• Have been designated by the patient and approved by the OCM
• Not be the same as the patient’s certifying health care provider

The registration of a caregiver does not cost anything; after registering as a caregiver, an individual receives a registry ID from the OCM. This allows him/her to make purchases for the patient through any RO. For minors, the caregiver should be either the parent or legal guardian of the patient.

Certification and registry cards from other states are not recognized by New York. The patients visiting must get themselves certified through a registered New York provider. After getting certified, they will automatically become registered and can purchase products without delay.

The duration of certification is normally one year; however, providers have an option to give less time. To renew, you need to consult another provider, and even telemedicine consultations can be considered. There is no renewal cost for the state.
