How to Qualify for Medical Marijuana in MS

by | May 4, 2026 | Minnesota | 0 comments

Mississippi transformed its health system in a way that greatly expanded the types of medical treatments that can be provided through the state’s medical cannabis laws, as a result of the passage of the Mississippi Medical Cannabis Act. For example, many patients in Mississippi who were not able to access a medical form of marijuana before now have access to this as a viable treatment option. Navigating the legal requirements to qualify for medical marijuana in Mississippi can be overwhelming; however, understanding the required steps for applying is critical to achieving success. As this resource helps to clarify the process of determining a person’s eligibility to obtain a Medical Marijuana Card, those who are suffering from chronic pain or who are providing support to such a person should know that this understanding will provide the base for obtaining physician-approved access to an approved medicine through proper legal channels.

Overview of Mississippi’s Medical Marijuana Program

Senate Bill 2095 was signed by the governor on February 2nd, 2022, and this measure establishes the Mississippi Medical Cannabis Program(MMCP). To clarify, the MMCP provides a means by which medical marijuana may be safely used in Mississippi by patients with debilitating medical conditions.

State Oversight and Regulatory Framework

MSDH handles all aspects of patient registration and practitioner certification. All Dispensary Licenses are issued by the MDOR. The dual-agency structure enables the dual-agency models to ensure that all grams of cannabis sold within the state to patients with qualifying conditions have been tested and monitored for sale as well.

Who is Eligible for Medical Marijuana in Mississippi?

Individuals must meet several core eligibility criteria in order to be able to participate in the program. Being eligible does not just mean that a person has a symptom; a person must be able to satisfy the legal definition that the state legislature has set forth.

Mississippi Residency

In order to be eligible for the application, applicants must live in Mississippi at the time of application. Patients residing outside of Mississippi and holding a valid patient or caregiver card from a qualifying state may apply for a 15-day visiting patient card, which is valid and can be confirmed for up to 30 days prior.

Diagnosis of a Qualifying Medical Condition

The law is specific about which illnesses qualify. You cannot simply “self-diagnose.” A patient must have a documented history of one of the state-approved debilitating conditions.

Certification from a Licensed Physician

Even with a diagnosis, you must receive an official “written certification” from a healthcare provider who is specifically registered with the MMCP to recommend cannabis.

List of Qualifying Medical Conditions in Mississippi

The State of Mississippi has a wide range of qualifying illnesses for both chronic and terminal conditions that are listed in the state’s qualifying conditions. If you have one of the following qualifying conditions, you may be entitled to receive a medical marijuana recommendation from the state:

  • Cancer
  • Epilepsy and other seizure disorders
  • Multiple Sclerosis (MS) or severe muscle spasms
  • Post-Traumatic Stress Disorder (PTSD)
  • Parkinson’s Disease
  • Huntington’s Disease
  • Muscular Dystrophy
  • Glaucoma
  • HIV/AIDS
  • Hepatitis
  • Amyotrophic Lateral Sclerosis (ALS)
  • Crohn’s Disease or Ulcerative Colitis
  • Sickle-Cell Anemia
  • Alzheimer’s Disease or agitation related to dementia
  • Autism (with aggressive or self-injurious behaviors)
  • Chronic Pain: Specifically defined as pain that is refractory to appropriate opioid management or where the cause cannot be otherwise treated.
  • Terminal Illness: Any condition where the life expectancy is less than 12 months.

Medical Evaluation Requirements

A formal medical evaluation must be conducted before receiving any recommendations. This is not a “pay-for-card” system; however, it is required by the state to have an intentional physician/patient relationship.

What Doctors Assess

During the evaluation, the practitioner will:

  • Review Medical Records: You should bring documentation of your diagnosis, past treatments, and current medications.
  • Conduct a Physical Exam: The doctor must see you in person for the initial certification.
  • Risk/Benefit Analysis: The doctor will assess whether the potential benefits of medical cannabis outweigh the health risks in your specific situation.

Physician Certification Process

In the state of Mississippi, not all physicians are allowed to recommend medicinal cannabis, as it is limited to MDs, DOs, NPs, PAs, and optometrists (within scope), all registered with MSDH who have undergone specialized training regarding the medical use of cannabis and are registered with the Mississippi State Department of Health (MSDH) to certify patients for cannabis use.

What the Recommendation Includes

A cannabis recommendation is an electronic file uploaded directly to the state’s online system and contains your medical form for your diagnosis, and states that Cannabis is a suggested course of treatment.

Term: Certifications are valid up to 1 year (practitioner discretion). Follow-up evaluations are required at least every 6 months or as specified.

Residency Requirements for Mississippi Patients

To prove residence in Mississippi, you must submit evidence showing where you and your family live. The state requires you to provide at least one of these forms of proof of residence:

  • Mississippi Driver’s License (valid).
  • MississippiState ID.
  • If you do not have an ID, alternative proof may include utility bills, lease agreements, or Voter Registration cards. However, the fastest and preferred way to prove your residence is with a state ID card.

Qualifying as a Minor in Mississippi

Patients under the age of 18 can qualify for medical cannabis, but the rules are much stricter to ensure safety.

  • Physician Requirements: Only an MD (Medical Doctor) or DO (Doctor of Osteopathic Medicine) can certify a minor.
  • Parental Consent: A parent or legal guardian must provide written consent and register as the minor’s official caregiver.
  • Caregiver Role: Minors are not allowed to enter dispensaries or purchase products; the caregiver must handle all aspects of the therapy.

Caregiver Eligibility and Role

A Caregiver is a person who has the legal authority to buy, transport, and provide a medical cannabis product to a qualifying patient who may not be able to do so themselves.

  • Who qualifies: To be able to register as a caregiver, you must be at least 21 years old and have no qualifying felony conviction.
  • Limitations: A caregiver is usually allowed to assist with the care of no more than five patients at any given time.
  • Restrictions: In addition to being at least 21 years old, a caregiver has to have a criminal background history check, and pay a registration fee to the state to be able to become a registered Caregiver.

Disqualifying Factors to Be Aware Of

If you have a qualifying condition, some factors can disqualify you from being approved.

  • Criminal History: Disqualifying felonies include violent crimes, drug felonies (within 5 years), or other specified offenses for caregivers.
  • Incomplete Application: Applications that do not include verified medical diagnoses for qualifying conditions may be rejected by the state.
  • Federal Law: Cannabis is federally illegal; someone (like someone with a CDL or a federal employee) who qualifies under state law will still be subject to job-related risks, despite having a state-licensed medical marijuana card.

How Long Does Qualification Approval Take?

The timeline from your first doctor’s appointment to holding a card is usually 15 to 30 days.

  • The Evaluation: 1 day.
  • Application Submission: 1–5 days (once the doctor uploads the certification).
  • State Review: The MSDH typically reviews and approves applications within 10 days (up to 15 total, including card issuance).
  • Digital Card Issuance: Mississippi uses digital cards. Once approved, you can download your card immediately and visit a dispensary.

What Happens After You Qualify?

The MSDH will notify you via email regarding the approval of your application, which will give you the status of a registered patient. You will then go to the State Portal so that you may view and download your Digital ID Card. Once you have your Digital ID Card, you will be able to legally access all of the state-licensed medical cannabis dispensaries operating within Mississippi. You may purchase up to six Medical Cannabis Equivalency Units (MCEUs) weekly, equating to approximately 21 grams of flower or an equal quantity of concentrates and edibles.

Common Questions about Qualifying (FAQ)

Can anxiety qualify on its own?

Currently, general anxiety disorder is not on the list of qualifying conditions. However, if your anxiety is a symptom of PTSD, you would qualify.

Can my primary care doctor certify me?

Only if they are registered with the Mississippi Medical Cannabis Program. Many primary care doctors are not, so you may need to visit a specialized medical marijuana clinic.

Can I be denied even with a condition?

Yes. A doctor has the right to deny a certification if they believe cannabis would be unsafe for you (e.g., due to a history of psychosis or conflicting medications).
