What Caregivers Can Do:

Caregiver Limitations:

A medical marijuana patient in Pennsylvania can designate up to two caregivers. If the patient is a minor, having at least one designated caregiver is mandatory — minors cannot purchase or possess cannabis themselves.

Application Process:

Caregivers must submit a separate application to the caregiver registry through the Pennsylvania Department of Health in order to receive their own caregiver ID card. You cannot act as a caregiver without this card.

Eligibility Requirements:

The requirements for a patient’s caregiver under the Pennsylvania Medical Marijuana Act include:

• Age of 21 or older.
• Residency in Pennsylvania and possession of documents confirming residency.
• Possession of an updated Pennsylvania Driver’s License or State-issued Identification Card.
• Undertaking a criminal history background check.
• Not having been convicted for drug offenses for the last five years. A recent drug conviction makes one not eligible to become a caregiver.
• Registering and obtaining a caregiver ID Card, which is granted by the Pennsylvania Department of Health and allows you to collect medical cannabis products from a licensed dispensary. 

Processing Time:

After completing your fingerprinting appointment as part of the background check process, it can take up to four weeks to receive a decision on your caregiver application status.

Minor patients under the age of 18 with a qualifying serious medical condition may participate in Pennsylvania’s medical marijuana program, but there are important differences in how the process works for them compared to adult patients.

It is important to note that minor patients do not get their own medical marijuana identification card. Rather, the Minor Patient Medical Marijuana Authorization letter is provided by the Pennsylvania Department of Health to the minor patient.

If you are the parent or spouse of the minor, then you are eligible for caregiver registration as long as you use the right caregiver checkbox while going through the state registration procedure.

However, if you are not a parent or spouse of the minor, then it is recommended that an “Authorization to Designate a Third-Party Caregiver” form be filled out. The form can easily be obtained by downloading it from the caregiver’s profile page in the state registration. After filling out the form, it should be uploaded to your caregiver profile.

In case a minor patient turns 18 while a certification cycle is still going on, his/her certificate will be automatically transferred over to him/her. But he/she would be required to fill out a new adult patient application on the pa.gov website. Once the adult patient ID number has been provided, you must contact the state to link the minor and adult accounts together.

Medical Marijuana Reciprocity Is Not Allowed for Visitors from Other States in Pennsylvania

The holders of MMJ cards from other states will not be allowed to buy medical marijuana in Pennsylvania.
